This document sets forth the Terms of Use (“Terms”) under which you may access and use the Islamic Relief USA (“IRUSA”) website (“Website”) located at www.IRUSA.org, including any media, software, programs, applications, products, services, and content, that we expressly adopt or make available (collectively, our “Services”). These Terms constitute a legal binding agreement between IRUSA (or “our” or “we” or “us”) and you.
IRUSA’s Proprietary Rights and Re-Use Policy
The materials on IRUSA.org and our mobile services are protected by copyright, trademark, patent, and/or other intellectual property laws, and any unauthorized use of the materials may violate such laws. You agree to comply with all applicable laws, governmental regulation and guidelines with respect to or otherwise arising out of your use of IRUSA.org.

IRUSA.org may provide links to other websites and resources. Because IRUSA has no control over these sites and resources, you acknowledge and agree that IRUSA does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

Claims of Copyright Infringement
The Digital Millennium Copyright Act of 1998 provides recourse for copyright owners who believe that material appearing on the Internet infringes on their rights under U.S. copyright law. If you believe in good faith that materials hosted by IRUSA infringe your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. Notices and counter-notices must meet the then-current statutory requirement.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE, CONTENT SERVICES, OR ANY LINKED SITE IS TO STOP YOUR USE OF IT.
IN NO EVENT SHALL IRUSA, OUR LICENSORS, OR ANY OF OUR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE CONTENT, SERVICE, OR THESE TERMS OF USE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY INCLUDING LOST PROFITS, BUSINESS INTERRUPTION, LOST DATA, PERSONAL INJURY (INCLUDING DEATH), AND PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, THAT RESULT FROM (A) THE USE OF, OR THE INABILITY TO USE, THE WEBSITE, SERVICES, OR CONTENT, OR (B) THE CONDUCT OR ACTIONS, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE WEBSITE OR SERVICES OR ANY OTHER PERSON OR ENTITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless IRUSA and our directors, officers, employees, and consultants, from and against any claim or demand (including reasonable attorney fees) arising from: (a) your activities in connection with IRUSA.org; (b) any violation of these Terms by you; and, (c) any allegation that any submissions or other materials you submit to us or transmit to IRUSA.org infringe or otherwise violate the copyright, trademark, trade secret, publicity right, or other intellectual property, privacy rights or other rights of any third party.
Notwithstanding the foregoing, IRUSA retains the exclusive right to settle, compromise, and pay any and all claims or losses associated herewith. You will not settle any claims or losses without, in each instance, the prior written consent of an officer of IRUSA. This section is not intended to limit any causes of action against us that you may have but are not waivable under applicable law.
Submissions of Content
Submissions of content, materials, and postings must be consistent with the following policy; violation of this policy may cause removal of the content by IRUSA. By posting content, you agree to the following terms and conditions.
- Submissions may not contain material that violates or infringes any person or entity’s rights, including, but not limited to any copyright or the rights of privacy and publicity as those rights are defined under applicable law.
- Material submitted may not be defamatory, threatening, harassing, abusive, obscene, disparaging of any individual or entity, or be hateful or embarrassing in nature.
- Submissions may not include the posting of materials protected by copyright law, regardless of whether the work has been registered or not, without the express written permission from the holder of those rights.
- Submissions may not contain the brand names, trademarks, trade dress, logos, seals, or other representations that may be associated with a specific organization or individual, without the express written permission of the party or parties having rights and titles to such materials.
- Submissions may not contain images, photos, or works of art that are not owned entirely by the submitting party.
- No images of children will be posted unless appropriate licenses have been obtained from the children’s parents or other guardians.
- Submissions may not contain information, content, statements, or representations that are inflammatory, dangerous, life-threatening, inappropriate, indecent, obscene, tortious, injurious, defamatory, or libelous. Submissions may not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, sexual identity, or age.
- Submissions may not contain material that is unlawful.
- Submissions may not be intended to promote or otherwise facilitate any commercial activity, and submissions may not be commonly understood as “spam”.
IRUSA reserves the right to remove any additional content, including links, in whole or in part for violations of this policy or because the content has been deemed unrelated to the postings or discussion taking place.
DMCA
We will investigate notices of copyright infringement and take appropriate actions under the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(2) (“DMCA”). If you (or your agent) believe that any of the content on our Website infringes your copyrights, please provide IRUSA’s designated copyright agent written notice (whose contact information provided below) with the following information:
- A legend or subject line that says: “DMCA Copyright Infringement Notice”.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification and description of the copyrighted work claimed to have been infringed, or, if you believe that multiple copyrighted works have been infringed on our Website, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit IRUSA to locate the material. Providing the full URL of the page(s) on our Website on which the material appears is the best way to help us locate content quickly.
- Information reasonably sufficient to permit IRUSA to contact you, such as your full name, address, telephone number, and, if available, an electronic mail address at which you may be contacted.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please provide all of the information requested above. No specific form is required to provide IRUSA with notifications of possible infringement. However, it will take IRUSA longer to process your notice if any of this information is not provided, and in some cases, we may not be able to process your notice.

Scams and Fraud
IRUSA often appeals for funds to support our ongoing projects or to help us respond to new emergencies, and we are thankful for our supporters who generously respond.
Unfortunately, sometimes people who have no connection to IRUSA use our name and logo to fraudulently try to raise their own funds. Other scammers may pretend to be IRUSA to try and obtain people’s personal or financial information. We try to do everything we can to stop this, but this is not always possible. If you see or receive any request for money that you believe may not be genuine, please do report it to us by contacting [email protected] or 1-855-447-1001.
Please also note: IRUSA never charges any recruitment fees for job applications. If someone claiming to be a recruiter for IRUSA ever asks you to make a payment as part of the application process, this is not genuine. Please report this to [email protected].
Donations
IRUSA is a non-profit, non-governmental international relief and development organization organized under the laws of the State of California with headquarters located at 3655 Wheeler Avenue, Alexandria, VA 22304. IRUSA, Tax ID No. 95-4453134, is exempt from federal income tax under 26 U.S.C. Section 501(c)(3) and is a non-profit organization eligible to receive tax deductible donations.
By making a donation, you acknowledge that you are at least eighteen years of age, legally competent, and agree to all other provisions of these Terms. You also agree that all details you provide to us for the purposes of making such a donation will be accurate, correct, including ownership and validity of any payment method such as a credit or debit card.
By using the Websites’ payment method, you confirm that you possess the legal authority to enter into the conditions of use for the Website, including, without limitation, instructing IRUSA or its authorized vendors to collect any payments from a payment card, and to use the Website in accordance with these Terms. You agree that you are responsible for all charges incurred by your use and purchases on the Website and you expressly authorize IRUSA to charge the payment card provided by you or listed on your account for any outstanding fees or costs due to IRUSA or any donations submitted online via the Website. You agree that you will not hold IRUSA responsible for any banking charges incurred due to payments made on your account.
Modifications
IRUSA reserves the right to make changes to these Terms at any time at its sole discretion by posting an updated version on the Website. IRUSA will post any changes to our services on these Terms, and changes are effective immediately upon posting. You are responsible for periodically reviewing these Terms for updates and amendments. Your continued use of our services constitutes acceptance of these Terms and is subject to the most current version of these Terms, which will be effective immediately upon posting. No amendments or modifications to these Terms proposed by you will be binding on IRUSA unless you have obtained the prior written consent of IRUSA.
Arbitration and Governing Law
In the case of any dispute, controversy or claim, the parties will attempt to reach an agreement amicably by direct discussions. If the dispute cannot be settled through direct discussions within sixty (60) days, You agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its commercial Mediation Procedures before resorting to arbitration. You further agree that any unresolved controversy or claim arising out of or relating to these Terms, or breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of arbitration shall be Alexandria, VA.
These Terms shall be governed by and construed in accordance with the internal laws of the Commonwealth of Virginia without giving effect to any choice or conflict of law provision or rule (whether of Virginia or any other jurisdiction) that would cause the application of laws of any jurisdiction other than those of Virginia. Any legal suit, action or proceeding arising out of or related to these Terms or the matters contemplated hereunder shall be instituted exclusively in the courts of Virginia in each case located in the City of Alexandria.
Severability
If any of the provisions in these Terms are determined to be not enforceable or valid in a final valid and enforceable decision, then such provisions will be deemed severed and will not affect the validity and enforceability of the other parts of these Terms, which other parts shall still apply.
Entire Agreement
These Terms constitute the entire agreement between you and IRUSA for the services and your use of the Website and content and supersede all existing agreements and all other oral, written or other communication as well as any prior proposals, negotiations, agreements, and understandings between you and IRUSA concerning its subject matter relating to the use of the services, Website or content.
Disclaimers and Disclosure Statement
Here is important information you need to know as you make your donations toward Islamic Relief USA’s humanitarian efforts.
It may take anywhere from 1-5 business days before charges appear on your credit card or bank statement. This may vary per credit card company or bank.
Each donation to IRUSA is tax deductible as and to the extent allowed under applicable law and represents a contribution to its mission of alleviating poverty and suffering wherever it is found, paying no heed to gender, race or creed.
Islamic Relief USA is committed to providing aid in the country or program that you select. In the event we complete the program, exceed the required funds, or are denied access to a particular country for reasons beyond our control, Islamic Relief USA reserves the right to reallocate your donation to another program where it is needed most.

DONATIONS
A portion of your donation will go toward administrative costs. The default option for donation payment is a one-time transaction.
One-time donations will only be processed as authorized for that specific transaction, per the given day.
In cases where recurring direct debit (available for U.S. banks only) or monthly credit giving options are available, you will be given the choice to select your preferred method of giving. By selecting recurring donation options, you authorize Islamic Relief USA to automatically transfer your gift each month from the account you provide—the transaction will appear on your checking account or credit card statement. The monthly charge date shall be the date in which the donation was initially submitted. If the monthly charge date needs to be changed, you may submit an email to [email protected] or call 855-447-1001 and request for the monthly date to be changed.
The financial institution you identify on the donation form is authorized to debit or charge your donation to the account indicated. This authority will remain in effect until you have given Islamic Relief USA at least 10 days notice that this authorization has been terminated. Please understand that you must give advance notice to allow reasonable time for your instructions to be executed. If ever an incorrect amount should be entered into your account, you authorize your financial institution to make the appropriate adjustment on your behalf.
*In cases when a month does not have 30 days, the transaction will be made on the following business day.

IMPORTANT NOTE REGARDING CREDIT CARD DONATIONS FOR ZAKAT: Please consider adding 2% when using Visa and Mastercard to your total zakat donation—this will compensate for any transaction fees deducted from your donation by the credit card companies, and will ensure that your intended zakat amount is paid in full.

REFUND POLICY
If you have made an error in making your donation to Islamic Relief USA, we will honor your request for a refund made within 30 days of your donation.
To request a refund, call 1-855-447-1001. Refunds are issued using the original method of payment. If you made your donation by credit card, your refund will be credited to that same credit card. If you made your donation through direct debit of your checking/savings account, check, or cash, your refund will be issued by check and sent to you via the United States Postal Service.
CHARITABLE SOLICITATION DISCLOSURE
For a copy of IRUSA’s latest annual report, audited financial statement or annual tax return, please send your request along with a self-addressed stamped envelope to Islamic Relief USA, Attn: Donor Care Department, 3655 Wheeler Avenue, Alexandria, VA 22304.

Florida
A copy of the official registration and financial information for IRUSA (Reg. No. CH26184) may be obtained from the Division of Consumer Services by calling toll-free 1-800-435-7352 within the state. Registration does not imply endorsement, approval or recommendation by state.
Georgia
Upon request, the following information will be provided by IRUSA: (A) A full and fair description of the charitable program for which the solicitation campaign is being carried out and, if different, a full and fair description of the programs and activities of the charitable organization on whose behalf the solicitation is being carried out; and (B) A financial statement or summary which shall be consistent with the financial statement required to be filed with the Secretary of State pursuant to Code Section 43-17-5. In addition, a copy of the financial statement filed by IRUSA (Reg. Maryland
Copies of documents and information submitted by IRUSA (Reg. No. 19173) are available for the cost of copies and postage from the Secretary of State, State House, Annapolis, MD 21401 or by calling toll-free 1-888-874-0013.
Mississippi
The official registration and financial information of IRUSA may be obtained from the Mississippi Secretary of State’s office by calling 1-888-236-6167. Registration by the Secretary of State does not imply endorsement.
New Jersey
Information filed with the attorney general concerning this charitable solicitation may be obtained from the attorney general of the state of New Jersey by calling 973-504-6215. Registration with the Attorney General does not imply endorsement. (IRUSA Reg. No. CH2760900)
New York
New York residents may obtain a copy of the annual report of IRUSA (Reg. No. 40-90-91) by writing to the office of the Attorney General, Charities Bureau, 120 Broadway, New York, NY 10271.
North Carolina

Additional financial disclosure information, including any notice of solicitation required by the Charitable Solicitation Act, may be obtained upon request made to the Secretary of State at 1-800-332-4483, or by e-mail at [email protected]. West Virginia
