According to the Immigration and Nationality Act (INA), a refugee is defined by several key characteristics:
“A refugee is someone who has been forced to flee his or her country because of persecution, war or violence. A refugee has a well-founded fear of persecution for reasons of race, religion, nationality, political opinion or membership in a particular social group. Most likely, they cannot return home or are afraid to do so. War and ethnic, tribal and religious violence are leading causes of refugees fleeing their countries.”
According to the UN Refugee Agency, asylum is defined as the following:
“A form of protection which allows an individual to remain in the US instead of being removed to a country where he or she fears persecution or harm. Under US law, people who flee their countries because they fear persecution can apply for asylum. If they are granted asylum, this gives them protection and the right to stay in the US. Those who are granted asylum are called asylees.”
